TERMS AND CONDITIONS - CLEANBUDDY CLEANING SERVICES LTD
These Terms and Conditions ("Terms") apply to all cleaning services provided by CleanBuddy Cleaning Services Ltd ("the Company", "we", "us", or "our") to the Client ("you" or "your"). By engaging our services, you agree to the following Terms and Conditions.
1. Services
1.1 The Company agrees to provide cleaning services as requested by the Client and as detailed in the service agreement or quote.
1.2 Any additional services requested must be agreed upon prior to the service visit and will be charged at the Company’s standard rate.
1.3 The Company will endeavour to carry out the services to the highest standard of quality and in accordance with applicable health and safety regulations.
2. Access to the Property
2.1 The Client is responsible for providing access to the property at the agreed-upon times for cleaning services. Access can be provided in the following ways:
- In person
- Key safe at the property
- The Company can hold a key, which will be securely code tagged.
2.2 If access to the property becomes unavailable, the Client must notify the Company at least 2 days in advance. Failure to do so will result in the full charge for the scheduled service being payable.
2.3 If an additional visit is required due to lack of access, this will be charged at the Company’s standard rate.
3. Payment Terms
3.1 The Client agrees to pay for the services as outlined in the service agreement or quote.
3.2 Invoices will be issued on a weekly, fortnightly, or monthly basis, as agreed between the Client and the Company. Payment is due within 2 days of the invoice being sent, unless agreed otherwise in writing.
3.3 Any additional cleaning time beyond the agreed scope of services will be charged at the Company’s hourly rate.
3.4 Failure to make payment within the specified time frame may result in suspension or termination of services.
4. Cancellation and Termination
4.1 The Client may cancel a scheduled service by providing 2 days’ notice. Cancellations made with less notice may incur the full charge for the service.
4.2 Either party may terminate an ongoing service agreement with 28 days' written notice.
4.3 The Company reserves the right to terminate services immediately if the Client fails to comply with these Terms or is in breach of any payment obligations.
5. Liability
5.1 The Company will take all reasonable care when performing services, but will not be held liable for any pre-existing damage to the Client’s property.
5.2 The Company is insured for liability arising from gross negligence or wilful misconduct while performing services. The Company is not liable for any indirect or consequential damages.
5.3 The Client must notify the Company of any damages or loss caused by the Company’s cleaning services within 24 hours of the service. Claims made after this period will not be considered.
6. Health and Safety
6.1 The Company will adhere to all applicable health and safety regulations during the performance of services.
6.2 The Client must inform the Company of any hazards, risks, or specific safety instructions related to the property.
7. Confidentiality
7.1 Both parties agree to keep any confidential information disclosed during the provision of services private and not to disclose it to third parties without prior consent.
8. Force Majeure
8.1 The Company will not be liable for any failure to provide services due to circumstances beyond its control, including but not limited to severe weather, natural disasters, or other events of force majeure.
9. Governing Law
9.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Estate Agents and Third-Party Payments
10.1 If the Client is an Estate Agent, the Estate Agent will be liable for payment of the invoice in the event that their client (the tenant or landlord) does not settle the invoice within the agreed payment terms.
10.2 If the invoice is to be paid upon the rent being paid (i.e. deducted from the rent), the Estate Agent must communicate this in writing to the Company prior to the service being carried out.
10.3 Failure to communicate such arrangements in advance will result in the Estate Agent being responsible for adhering to the Company’s standard payment terms, with payment due within 2 days of the invoice being sent.
11. Cleaning Products and Equipment
11.1 The Company will supply all necessary cleaning products and equipment to complete the services, unless otherwise agreed with the Client in advance.
11.2 The Company uses professional-grade cleaning products that are safe for general use. If the Client requires the use of specific products (e.g., eco-friendly or allergen-free products), this must be communicated in advance. Any additional costs for specific products may be charged to the Client.
11.3 The Company is not liable for any damage caused by the use of cleaning products if the Client has not informed the Company of any known sensitivities, allergies, or special requirements regarding cleaning products.
12. Property Condition
12.1 The Client is responsible for ensuring that the property is in a safe and sanitary condition for cleaning staff. If the property is in an excessively hazardous or unsanitary condition, the Company reserves the right to refuse service.
12.2 If additional cleaning time or resources are required due to the condition of the property, the Client may be charged at the Company's hourly rate for the extra time or products required.
13. Pets and Special Instructions
13.1 The Client must inform the Company if there are any pets on the premises, along with any specific instructions regarding their care or containment during the cleaning service.
13.2 The Company will not be held responsible for any harm to pets or damage caused by pets if the Client has not provided specific instructions for their management.
14. Parking and Access Arrangements
14.1 The Client must provide clear information about any specific parking arrangements, restrictions, or permits required for the Company’s staff to access the property.
14.2 If parking permits are required, it is the Client's responsibility to arrange them in advance. Failure to provide appropriate parking may result in delays or the rescheduling of the service.
14.3 Any parking fees incurred by the Company while accessing the property will be added to the Client's invoice unless a free parking space is provided.
15. Client's Responsibilities
15.1 The Client must ensure that the property is ready for cleaning, with valuable items stored securely and any hazards removed or communicated in advance.
15.2 If the Company’s staff are unable to access certain areas or items due to obstructions or safety concerns, these areas/items may not be cleaned, and no refund or deduction will be given.
16. Valuables and Fragile Items
16.1 The Company is not responsible for any damage to valuables, delicate, or fragile items that are not securely stored or adequately protected during the cleaning process.
16.2 The Client is responsible for notifying the Company in advance of any particularly fragile or sensitive items that require special care.
17. Amendments
17.1 The Company reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client in writing.
